Tell the Senate: Block and resist Andrew Wheeler for EPA Administrator

Andrew Wheeler wants to convince us that he is a more moderate, ethical leader for the EPA than his predecessor Scott Pruitt. Don't be fooled.

Wheeler is a former coal lobbyist who rejects climate science and tweets racist and extremist right wing content. In his short time as Acting EPA Administrator, he has reversed key environmental protections with lethal efficiency. He is anything but moderate.

Now Trump has nominated Wheeler as permanent EPA Administrator. As the Senate considers his confirmation, we need to make sure that our senators know where we stand. Putting a coal lobbyist in charge of environment protection is completely unacceptable.

Far from his carefully cultivated image as the "grown up" version of Scott Pruitt, Wheeler lives in the fact-free, conspiracy-filled world of the extreme far right.

His social media record is telling – and disturbing. In 2013, Wheeler "liked" a racist Facebook post dehumanizing Pres. and First Lady Obama.1 After Twitter banned alt-right troll Milo Yiannopolous for encouraging fans to harass actress Leslie Jones, Wheeler shared an Infowars video defending him.2 Just this year, he retweeted a Pizzagate conspiracy theorist.3

Wheeler's relationship to reality is just as tenuous when it comes to science.Wheeler tweeted links promoting climate change denial in 2009, 2011 and 2015.4 He is a former adviser to notoriously anti-science Sen. James Inhofe, who once brought a snowball to the Senate to disprove climate change.

As the Acting EPA Administrator, Wheeler has been just as destructive as Pruitt. He is working to roll back fuel efficiency standards and put more brain damaging mercury in the environment.5 He put the head of the Office of Children's Health Protection on administrative leave without cause and removed mentions of climate change from the EPA's website.6

Like Pruitt, Wheeler has shown that partisanship and career ambition are more important to him than avoiding ethical conflicts of interest. When Trump first nominated Wheeler as Deputy EPA Administrator, Wheeler smoothed hosted fundraisers for Republican senators on the committee responsible for advancing his nomination.7

Even with a Republican-controlled Senate, public pressure has forced Trump to withdraw some of his most controversial nominees.8 Other Trump officials have resigned after news broke about their own past racist statements.9 With enough pressure on the Senate, we can block Wheeler's confirmation.

Tell Senators: Reject racist judge Thomas Farr

Thomas Farr became an expert in suppressing Black votes as the protege of notorious racist Sen. Jesse Helms and spent decades developing close ties to one of the most despicable white supremacist organizations in the United States.1

Now Donald Trump and Mitch McConnell want to give Farr a lifetime appointment as a federal judge.2

We cannot let the Senate confirm Farr without a fight. Every voice in opposition to putting a racist like Farr on the federal bench helps illuminate Republican leaders' open embrace of white nationalists and voter suppression.

The Rev. Dr. William Barber, leader of the Moral Mondays Movement and the Poor People's campaign, declared that Farr is unfit to be a federal judge because of his "long record as an advocate for hyper-partisan, segregationist causes."3 In fact, nearly every civil rights organization has lined up to oppose Farr.

Farr's record shows a judge only Donald Trump could love. He:4

  • Helped draft and defend a 2013 North Carolina's 2013 voter ID law that a federal court struck down because it targeted black voters "with almost surgical precision"
  • Has close ties to the Pioneer Fund, a hate group "established to use science to pursue the goals of its founder: the preservation of white supremacy and white racial purity from the threat posed by blacks and undesirable immigrants, especially Jews," which was one of the major funders of the fight in the South against the Civil Rights Movement
  • Spent years working alongside Thomas Ellis, a strident segregationist and racist who built a political network to maintain white supremacy
  • May have lied about his role in illegal voter suppression efforts while working on the campaigns of unrepentant racist Sen. Jesse Helms
  • Continues to praise his mentor Helms, despite Helms' refusal to apologize for opposing civil rights and his fights to keep Black judges off of the federal courts

Racism. Voter suppression. Eugenics. It's all there in Thomas Farr's friends, clients and mentors. This man has no place on the federal bench.

Mitch McConnell is determined to ram through as many right-wing judges as possible before the end of the year. All 49 Democratic Senators oppose Farr and Sen. Jeff Flake has said he will refuse to vote for any judicial nominees until there is a Senate vote to protect the Mueller investigation. McConnell has to hold every other Republican vote to get Farr confirmed. We must raise our voices now to show Republicans we are paying attention and to demand they vote no on this racist judge.

Tell Congress: Stop the Native American land grab

It's absolutely deplorable: Western-state Republicans are once again attempting to rip sovereign tribal land away from Native Americans in Utah and give it to the fossil fuel industry.1

After failed attempts in 2016 to strip lands from the Ute tribe, which more than 150,000 CREDO members opposed, Rep. Rob Bishop and Sen. Orrin Hatch are pushing hard for Congress to pass legislation once again to hand over Native reservation land to extractive industries during the lame-duck session just before Democrats take control of the House.

Their bill is not only a huge giveaway to the fossil fuel industry, it would also be the first Native American land grab in over 100 years. We must demand that Congress prevent this bill from ever getting a vote in Congress.

This legislation is just the latest attempt by Rep. Bishop and other enemies of Native and public lands to undermine sovereign land and water rights. In 2016, Rep. Bishop introduced legislation that would have stripped away protections for 100,000 acres of Ute tribal lands to allow for oil drilling and uranium mining and would have prevented then-President Obama from designating 18 million acres of unprotected land at Bears Ears a national monument.2 And it's no surprise why: After becoming chair of the House Committee on Natural Resources, Bishop got a massive payout to his campaign, receiving hundreds of thousands in contributions from the energy, agribusiness and oil and gas industries.3

In addition to stealing indigenous tribal lands, this Republican bill, dubbed the Emery County Public Land Management Act, would neglect to protect more than 1 million acres of public lands, transfer public lands to the state of Utah and allow for destructive, motorized recreational use. And according to the Grand Canyon Trust, "Native American tribes were totally excluded from deliberations" and "countless important rock art panels and other cultural sites are left available for oil and gas drilling, and that's just unacceptable."4

We stopped Republican efforts to steal Native lands before, and we can do it again. We must act now before the end of the congressional session to demand that Congress stop this modern-day Native American land grab. Click the link below to sign the petition:

Stop Betsy DeVos' attack on student sexual assault survivors

Betsy DeVos is trying to make it easier for schools to sweep campus sexual assault under the rug.

Cheered on by conservatives and so-called men's rights groups, the Department of Education recently released proposed rule changes to Title IX, the landmark legislation that prohibits gender discrimination at schools that receive federal funding.1 If enacted, the rule changes would almost certainly deter survivors from reporting harassment and assault. Those who do report will be much less likely to see their schools take action and the small number whose reports result in an investigation will then face a retraumatizing and invasive process.

In the era of #MeToo, when survivors of sexual assault are starting to be comfortable speaking up, this will only serve to protect perpetrators and roll-back institutional responsibility for addressing sexual misconduct. DeVos cannot just ram this through – the Department of Education must listen to the public. CREDO is joining partners including UltraViolet, End Rape on Campus and the National Women's Law Center to create a massive public outcry opposing these changes. Will you sign the petition?

In recent years, students and advocates have made great strides in reducing campus sexual assault, holding perpetrators accountable, ensuring equitable and trauma-centered adjudication processes, and helping survivors get the accommodations they need to continue their education. Title IX and the Obama administration's guidelines for its implementation have been crucial tools in that work, but DeVos wants to roll back important Title IX protections.2

If DeVos gets her way, many of those protections will be eroded. The proposed rule changes would:

  • Relieve schools of the responsibility to investigate harassment and assault unless survivors report to specific, designated employees. If students who are more likely to have a trusting relationship with another school official, such as a coach or adviser don't find the "right" person to report to, the school will not be obligated to take action.3
  • Limit the definition of harassment so that schools are required to ignore complaints until the harassment is so bad it interferes with student learning – that is, until a survivor drops out of class, reports of the harassment will not be taken seriously.4
  • Require administrations to dismiss complaints – even if they are reported to the "right" school official – about off-campus incidents. That includes reports of harassment across the street from campus, in off-campus student apartments or even repeated online harassment. Dismissal of these reports means that survivors might need to face their harasser or abuser in class every day.5
  • Change the standard of evidence in campus adjudications to tilt the investigation in favor of reported harassers and rapists. Even if schools use a preponderance of evidence standard in all other student disciplinary cases such as cheating, the rule change would allow for a stricter standard for cases of sexual assault.6
  • Guarantee that accused perpetrators have the right to cross-examine the survivors who report them. In an almost certainly retraumatizing process, survivors would be required to face their assailants or their representative – and for wealthy perpetrators, that could mean an inquisition from a high-paid lawyer experienced in shredding survivors' accounts.7

If DeVos gets her way, schools will be off the hook for keeping their students safe. These proposed rule changes only serve to protect the likes of the Larry Nassars and Brock Turners of the world.
